In our legislators competition to introduce the stupidest bill, Rep. Jim Kerr (R) makes an impressive effort sponsoring House Bill (HB) 1023 which would make it a crime to possess graffiti tools (e.g., spray paint)! The term "graffiti tools" is not defined in the bill. To further embarrass himself, Rep. Kerr actually included the safety clause in the bill!!! Also, in an apparent effort to prove that Republicans don't corner the market on stupidity, Sen. Betty Boyd (D) is actually sponsoring this bill in the Senate!!!

A free society embraces free-market capitalism. But Rep. Paul Weissman (D) doesn't like free market capitalism. So he has sponsored HB 1140, which would repeal statutory provisions prohibiting counties and municipalities from enacting any ordinance or resolution that would CONTROL RENTS on private residential property! If government can dictate the rent charged for private residential properties, then how is it private? Apparently Weissman doesn't quite grasp the concept of PRIVATE property -- or how the free market works.

Few Coloradoans realize that most homeowners' associations (HOAs) are non-profit corporations -- governed by state statutes. As a non-profit corporation, an HOA is an agent of the government (in effect, a sub-division of government). In Colorado, HOAs are governed under the Colorado Revised Statutes (CRS), Article 33.3, Colorado Common Interest Ownership Act. Arguably, more property rights are violated at this most local level of government than any other. When a homeowner's property rights are violated by their HOA, they have few options -- other than to move.
Sponsored by Rep. Morgan Carroll (D), House Bill (HB) 1135 would invalidate covenants, rules, or policies of common interest communities (CICs) that prohibit reasonable modifications of a structure as necessary to allow access by persons with disabilities (in accordance with federal law). HB 1135 would also require CICs to adopt and follow written policies for the imposition of fines on unit owners that, at a minimum:
- Create a fair and impartial method for determining whether a violation of the covenants actually occurred and whether the unit owner is responsible for the violation; and
- Provide the unit owner notice and an opportunity to be heard before an impartial decision maker.

Over the past few years the Libertarian Party, along with our partners in freedom, has successfully utilized automatic dialing machines to inform voters of many issues. Apparently, at least one legislator has become annoyed by our calls to action!
Sponsored by Sen. Maryanne "Moe" Keller (D), Senate Bill (SB) 048 would prohibit political telephone solicitations made by automatic dialing machines or by paid political solicitors to anyone in Colorado or registered to vote in Colorado, except on the basis of a pre-existing relationship formed prior to the call. Exempts bona fide candidates, officeholders, and political parties that make calls to announce town meetings, fund-raisers, and other events of interest to existing constituents and supporters.
In conflict with the Constitution of the State of Colorado, Article II - Bill of Rights, Section 10 - Freedom of speech and press; SB 48 is a blatant and outrageous attack on free speech! In the 21st century, using automatic dialing machines to inform and educate voters of pending legislation and ballot issues is an essential element of a free society!

Rep. Don Marostica (R), a land developer, is sponsoring House Bill (HB) 1015. This bill would authorize the governing bodies of counties and municipalities to appropriate moneys for the purpose of MARKETING their county or municipality!!!
As marketing counties and municipalities is not a proper role for government, one can only surmise that this bill is designed to funnel tax dollars to favored marketing and advertising firms -- thus promoting cronyism. Perhaps Rep. Marostica would like for those counties and municipalities where he engages in land development to perform some marketing. This bill presents an obvious conflict of interest.

In 2005, and again in 2006, the people of Denver made it clear they do NOT want adults arrested or prosecuted for simply using or possessing small amounts of marijuana. However, the City has continued to arrest adults in Denver for simple marijuana possession; and there have been more arrests than ever before!
Our Partner in Liberty, SAFER, has proposed an initiative that would create a city ordinance designating adult marijuana possession Denver's lowest law enforcement priority. This marijuana reform measure will be on the upcoming all-mail ballot in Denver.
The Denver City Council and Mayor say they are opposed to following the will of Denver voters and ending arrests for adult marijuana possession because somehow that would send the wrong message to children. Yet they have no problem officially partnering the City of Denver with Coors Brewing Company and promoting Coors beer in all city-operated theaters and arenas. What message does that send?
