Man to challenge marijuana possession charge
HIV positive man charged with possession of less than 1 ounce marijuana and is going to challenge his charge based upon Denver's passage of Initiative 100 last November. I-100 allows for the limited possession of less than an ounce of marijuana.

Donations needed to fight City Hall (literally)
Last year we worked with our Partner in Liberty, Lakewood T Party, to oppose a sales tax (2A) increase in Lakewood, CO. Although the election results were extremely close, we lost and the sales tax passed.
HOWEVER, after the election, Lakewood T Party learned that the Lakewood Housing Authority (City of Lakewood) had illegally contributed $10,000 (of public funds) to the Yes on 2A Campaign! This was one of the largest single contributions received by Vote Yes on 2A!
The donation was returned to the housing authority nearly two months later, but the check was cashed and mingled with other campaign money before it was returned weeks after the election. Colorado election law prohibits the use of public funds to endorse any candidate or ballot measure.
Members of the housing authority board of directors acknowledged (admitted to) the "mistake" and issued a public apology during a recent City Council meeting.
Now, Case No OS 2006-0003 Filed by Lakewood T Party, "Violations by Lakewood Housing Authority and Vote Yes on 2A" will be heard on March 22 at 9:00 am.

SUPPORT HCR 06-1001 to Limit Eminent Domain Abuse!!!
Last week Representative Al White (HD57-R) introduced his referred measure (House Concurrent Resolution 06-1001), which is identical in language to the Colorado Citizens for Property Rights (CCPR) initiative we are working so hard to gather signatures for, to the House Committee on State, Veterans, & Military Affairs. We are supporting both efforts because it gives us two avenues to get this important language to voters in this November's election. If one fails, the other becomes our best hope. Rep. White's referred measure, if passed, will provide language to the Colorado Constitution greatly limiting the abuse of eminent domain.
After more than 3 hours of testimony from citizens telling their own horrific tales of having been victims of eminent domain abuse, the committee voted unanimously (although with some grumbling) to pass HCR 1001 to the House of Representatives for its first reading (and vote).
It is imperative that the Colorado House of Representatives understand that the power government holds is derived from the people for the sole purpose of protecting the rights of the people.

Help STOP Mandatory Seat Belt Laws
In last weeks LPCO Liberty Alert, I alerted everyone to HB 06-1125, revising Colorado Revised Statute 42-4-237. This legislation would make it a PRIMARY offense, punishable as a class B traffic infraction (No points, but a fine of between $15 to $100 plus "additional" surcharges), for a driver to operate a motor vehicle without the driver, certain children, and all front-seat passengers wearing fastened safety belts. This bill will eliminate the requirements for an offender to pulled over for some other offense before being ticketed for not wearing a seat belt.
Through our phone calls and e-mails, we were able to turn the tide in our favor! Right now, we have barely enough legislators opposing this bill to defeat it! But supporters of Nanny Statism are not easily deterred. The House is laying this bill over daily - with supporters trying to sway opposing legislators. We need to keep the pressure on!
STATUS: HB 06-1125 was narrowly passed in the House on Feb. 15 by only one vote (33-32). The bill was then passed in the Senate on March 10 (vote was 20-14) with some minor amendments. Now the bill is stuck in the House for a final vote - any day now.

Talking Points:
1) This bill will promote police monitoring who is wearing their seat belts rather than tracking down REAL criminals - such as murderers, thieves, rapists, etc.
2) This bill just creates more paternalistic regulations / victimless crimes,
3) This bill is not about saving lives. It's about Colorado receiving $12.6 M in additional federal funding (see the associated fiscal notes) if we prove 85% seat belt usage rate. HOWEVER, no additional laws are needed. Fox 31 news performed an informal count at a traffic light last week and observed a 91% seat belt usage rate. Therefore, this law is completely unnecessary for Colorado to
receive these federal funds! The federal funds are simply an excuse by Coleman and friends for greater Nanny Statism!

Support the Online Freedom of Speech Act (H.R. 1606)
Federal courts have ordered the Federal Election Commission (FEC) to regulate "electioneering communications" on the Internet because of the Bipartisan Campaign Finance Reform Act (McCain-Feingold). If H.R. 1606 fails to become law, your Web site or blog could be shut down for the 30 days prior to a primary election and the 60 days prior to a general election should you express
"electioneering communications." And any e-mail you send expressing such opinions could also be disallowed.
So, grass-roots political activism will be silenced. But The New York Times, won't be muzzled because they are exempt as members of the "official press." They will be allowed to write editorials about the candidates, but you won't have approval from the State to say a word.
ACTION: Urge your representative to vote "yes" when it comes up for a vote and ask family and friends to do the same.
