CHEYENNE — Wyoming Attorney General Bruce Salzburg said the state will ask the U.S. Supreme Court to review a federal case involving a Colorado man who died during a struggle with Wyoming Highway Patrol officers in 2002.

Relatives and the estate of Bruce James Weigel can proceed with their lawsuit against Wyoming. Weigel's relatives claim Wyoming troopers used excessive force in subduing Weigel after a traffic accident. Court records say Weigel died after a trooper put weight on his back while he was handcuffed.
It is hard for me to understand why Wyoming is fighting this so hard, do they really think that having people die at the hands of the police is such a common occurrence that it should not be subject to a lawsuit for use of excessive force? They are desperate to keep this case from going to court. If they have nothing to hide and their officers are innocent, then you might expect them to welcome a trail in order to clear the officers. The courts and the police are on the same side and have the same employer after all, so this should be a slam dunk for the state. Average citizen vs government agency, tried by government agency, and yet the government is still afraid of losing.
